We offer professional assistance in quantifying damages claims involving construction and building contracts. Such construction or building contracts can be between employer and contractor or subcontractor and contractor.
We are experienced in and fully conversant with NEC, GCC, FIDIC, JBCC contracts and their related subcontract agreements. We are available to give expert evidence in adjudication, arbitration and litigation matters and to also assist in attempting to resolve disputes by way of mediation.
We usually become involved where damages are claimed following a disagreement between parties in a construction or building contract and the disagreement has not been resolved.
When analysing the amount of damages claimed, we take into account, inter alia, a claimant’s efforts to mitigate damages, a contractor or sub contractor’s cost accounting system and the method used to calculate damages.
Analysing damages claimed often includes an audit of the contractor’s or subcontractors project cost ledgers. Our aim is to establish if damages claimed in a particular situation are reasonable in the circumstances.
